Austin Shooting Suspect Not In Custody

Updated: Monday, March 10 2014, 05:35 PM CDT

Police are searching for an Austin homicide suspect who said his gun went off accidentally, killing a man he was trying to defend from an attack.

On March 1, Edgar Cruz Macedo, 26, was shot to death in the bathroom of the Club Zoto de Oro on Burleson Road near Ben White Boulevard.

Arturo Torres is charged with manslaughter.  He is not in custody.

According to an arrest affidavit, a security guard went to investigate a fight in the bathroom and found Macedo's body on the floor. A man with a handgun pushed past him and ran from the club.

The suspect drove away but the guard got the license plate number of the SUV he was driving.  The license plate came back to a man who said Torres had sold him the car, the affidavit said.

Macedo's brother received a phone call from Torres' brother. According to the affidavit, Isidoro Torres said his brother told him he accidentally shot Macedo. Arturo Torres said Macedo was in a fight with two men. He said he pulled out his handgun to defend Macedo when, during a struggle, one of the attackers grabbed the gun and it went off, the affidavit said.
