Lawyer: Family 'Relieved' After Settlement In Cedar Creek HS Tasing Incident

As of Wednesday morning, no comment from Bastrop officials on a $775,000 settlement to the family of Noe Niño de Rivera, who was tased inside Cedar Creek High School in November 2013.

Adam Loewy, the family's attorney, says the settlement money will help cover a good chunk of the more than $1 million in medical bills. The teen was in a medically-induced coma for 52 days following the incident.

At the time deputies were trying to break up a fight inside the hallway of Cedar Creek HS. Bastrop County Sheriff's Deputy Randy McMillan said he used a Taser on Rivera because the teen was combative. The teen hit his head on the ground after being tased. As of Wednesday morning, he continues to recover from the injuries he sustained that day.

"We're happy it's done," said Loewy. "We're happy it's resolved. Noe and his family have been through an enormous amount in the past ten months. He's doing better medically, and he really wanted to put this behind him."

With the settlement, Bastrop County does not accept fault for the incident. In May a grand jury found there was not enough evidence to indict McMillan. The county's insurance carrier did decide it was in their best interest to settle.
