Interrogation Room Video Played During Daniel Trial

Updated: Monday, February 24 2014, 12:14 PM CST

While sitting in the back of an Austin police cruiser, Daniel is caught on dash cam video saying "can I get the lethal injection? Is that possible?"

His chilling comments came minutes after he shot and killed senior police officer Jaime Padron in a Walmart off Parmer Lane and I-35.

During the second day of testimony homicide investigator Brett Bailey talked about the type of bullets fired from Daniel's .380 caliber handgun.

"Hollow points spread out and typically cause more damage," said Bailey.

The state claimed one of those hollow point bullets struck and killed Padron. It was found lodged in a styrofoam cooler covered in the officer's blood.

That testimony was too much for Padron's family to handle. One unidentified woman had to be helped out of the courtroom.

During a police interrogation held just two hours after the deadly encounter at APD headquarters, Daniel seemed to grasp the severity of his actions.

Homicide detective Heather Robinson asked Daniel what he thought should happen to him.

"Be put to death. I killed a cop," said Daniel.

Daniel told Robinson he bought the gun he used to kill Padron at a pawn shop in Colorado. He said he didn't intend to shoot Padron in the face, but added, "it was right there."

If convicted of capital murder Daniel could face the death penalty.
