APD: Death Of Suicidal Man Shot With Taser/Bean Bags Under Investigation

Updated: Monday, August 25 2014, 05:13 PM CDT

Police say they are investigating why a man died last month a day after being shot by officers with a bean bag and Taser during an attempted suicide call in Southeast Austin.

The incident happened July 24 at around 9 a.m. at an apartment complex in the 2200 block of Willow Creek Drive, just north of Oltorf Street and west of Pleasant Valley Road.

Police say officers responded to an attempted suicide call and found 33-year-old Timothy Rice in an apartment with apparent self-inflicted wounds to his body.

Investigators say when the officers confronted Rice, he began approaching them with a tomahawk in his hand, raised above his head -- and one officer, fearing for his life, fired bean bag shotgun rounds, striking Rice.

Police say a struggle ensued and Rice was also shot with a Taser.

Rice was taken into custody and transported by Austin-Travis County EMS to University Medical Center Brackenridge, where he was pronounced dead the next day at around 5 p.m.

Investigators say an autopsy was conducted by the Travis County Medical Examiner's Office -- the results of which are still pending.

Police say the case is currently under investigation by the APD Special Investigations Unit and the Travis County District Attorney's Office Critical Incident Unit. Anyone with information is asked to contact APD SIU at 512-974-9004.
