Judge To Decide If 16-Year-Old Will Be Tried As Adult For Capital Murder


A 16-year-old South Texas boy charged last year with attempted capital murder in state juvenile court is to go before a judge for a decision on whether he'll be tried as an adult in the shooting of a federal agent.
 
U.S. Immigration and Customs Enforcement agent Kelton Harrison was conducting surveillance as part of a drug trafficking investigation in July 2012 when he was chased and shot.
 
A criminal complaint accused the boy, whose identity is being withheld because of his age, of firing about six shots from a .22 caliber rifle. It also alleges that his 18-year-old brother Arnoldo Alvarado fired "numerous" shots from a 9mm handgun as they rode in a vehicle driven by their father Pedro Alvarado. The older Alvarados await trial in federal court.

The hearing is scheduled for 9 a.m.
