Man Charged In Connection With Austin Teen's Death; 2nd Man Wanted On Parole Violation


An Austin man is accused of giving alcohol to a 13-year-old who died on New Year's Day, and another man allegedly involved in the crime is wanted on a parole violation.

Mario Angeles-Hernandez, 23, is charged endangering a child, a felony. Jose Richardo Garcia-Zavala (pictured), 23, is wanted on the parole violation. Neither man is in custody.

Sophia Martinez, 13, a student at Garcia Middle School, was dropped off at a friend's doorstep on Jan. 1. She was not breathing and was pronounced dead a short time later.

According to an arrest affidavit, Sophia was supposed to spend the night with a friend. The 15-year-old old told police a man picked them up and they went to a home on Lambs Lane near William Cannon Drive and Pleasant Valley Road.

That's where the two men there gave the girls alcohol, the affidavit says. The 15-year-old told police Sophia drank nine cocktails – five with Gray Goose vodka and four with whisky.

The friend fell asleep. When she woke up, she could not wake up Sophia. The affidavit states the 15-year-old asked about calling an ambulance but the men "did not want any drama at their house."

After 30 minutes, the men dropped both girls off at a home on Lakehurst Drive in Southeast Austin, according to the affidavit.

Police interviewed the two men. The affidavit says Angeles-Hernandez admitted he gave the girls alcohol. Garcia-Zavala also admitted he was at home, according to the affidavit.  

Investigators are still awaiting toxicology results from Martinez's autopsy. Police say injury to a child charges could be filed against the men in the future.
