Jury In West Austin Hit And Run Heads Home For The Night


The jury for the Gabrielle Nestande fatal hit and run trial went home Wednesday night without deciding on a verdict

It was a difficult day for the jury. Earlier in the day the judge received a note from the jury at around 3:40 p.m. that said they were having difficulty reaching a decision on a verdict.

The judge called everyone into the courtroom and gave the jury further instructions, urging them to try to reach a verdict and said the case could be retried again with a new jury if they couldn't finish the job.

She then sent them back to deliberate further, and they did, but by 9 p.m. they asked to go home. They'll try again for a verdict Thursday morning.

Nestande is accused of hitting Courtney Griffin with her car in West Austin back in May 2010 and then leaving the scene. Griffin was found dead in the driveway of a home.

She's is charged with intoxication manslaughter, manslaughter, criminally negligent homicide and failure to stop and render aid.
